In NYC, No Guarantees Against Bedbugs

In major cities like New York, fear of an infestation of bedbugs is becoming a serious consideration among buyers.

Jerry Feeney, an attorney who writes a weekly column on real estate legal issues for the New York Daily News,says potential buyers have begun asking lawyers to insert clauses in contracts guaranteeing that there are no bedbugs.

Feeney says such a clause won’t hold water. While a seller may have no knowledge of infestations in the unit he’s selling, he can’t guarantee that there are no bedbugs building wide.

Instead, Feeney suggests that concerned buyers examine the building’s extermination program and satisfy themselves that its management has a process in place to deal effectively with all kinds of pests, including bedbugs, roaches, rodents, and other disgusting creepy-crawlies.
